The minutes of the meeting held on the 25 April 2016 were confirmed.

 

 

4 EXCLUSION OF PUBLIC
In the event of the Committee wishing to exclude the public from the meeting, the following resolution will be moved:-

"That under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the following item of business on the grounds that it involved the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 12(A) of the said Act."

To consider any other business as may be determined by the Chairman of the meeting as being of sufficient urgency to warrant consideration.

The Licensing and Elections Manager reported that due to new case law, suspension of a licence shouldn’t be given as an interim measure and the more appropriate method may be to revoke a licence in the interest of public safety under S61 of the Act.  Under the current Constitution officers do not have the delegated powers to revoke.

 

David Lowens, solicitor advised that a report would be required to go forward to the Committee to agree delegations, but that temporary delegation could be agreed until the next meeting of the Licensing Committee.

 

 

RESOLVED :

 

That temporary delegation be given to the Director of Customer Services and the Licensing and Elections Manager to exercise any power of the Committee under Section 61 of the Local Government (Miscellaneous Provisions) Act 1976.
