The minutes of the meeting held on 22 February 2025 were confirmed as a true record with the following amendments in regard to application 06/22/0827/D, Land at Wheatcroft Farm, Bradwell:-

 

(i) At page 35 of the Agenda, paragraph 2, (i) reference to Phase 5 should be phase 6; (ii) the minutes should record that Ms Sherman had confirmed the Pegasus Crossing would be a signalised junction and that the works would be completed prior to first occupation; (iii) the Development Manager had confirmed that a condition would be able to secure the signalised crossing, and confirmed that it had already been stated to be a requirement by the Highways Authority but the plans submitted to date had not reflected the applicant’s updated position. 


The Development Manager confirmed to Cllr Annison that the permission has now been issued with a relevant condition attached which requires the crossing to be signalised and the details to be agreed. – see condition 9 of 06/22/0827/D:-


Signalised Pegasus Crossing details and provision:-

(a) Notwithstanding the details indicated on the submitted drawings, no works above slab level shall commence on site until detailed drawings and plans for providing a signalised crossing at the Pegasus Crossing serving the Public Right of Way known as Clay Lane (Bridleway Bradwell BR10/BR16) have first been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be undertaken in strict accordance with the details as approved.


(b)There shall be no occupation of any dwelling within the development hereby permitted until the signalised Pegasus Crossing (including any related Public Rights of Way works) referred to in part (a) of this condition has first been completed and made available for public use to the written satisfaction of the Local Planning Authority in consultation with the Local Highways Authority.


Reason: To ensure that the highway improvement works are designed to an appropriate standard to promote safe access to the public rights of way network in the interest of highway safety and to protect the environment of the local highway corridor and promote sustainable travel.”


(ii) At page 35 of the Agenda – paragraph 3 – reference to duct suppression should be amended to dust suppression.


(iii) At page 35 of the Agenda – paragraphs 8 and 10 – references to the A143 should be amended to the B1534 (Beaufort Way).  


(iv) At page 35 of the Agenda – paragraph 9 - Cllr Murray-Smith requested that the minutes recorded that he considered the relevant Department for Transport Officer to be an ‘idiot’, not any local authority personnel.

The Committee received and considered the report and addendum report from the Planning Officer.

 

The Planning Officer reported that this application was reported to the Monitoring Officer as an application submitted by a Councillor and member of the Local Planning Authority Development Management Committee.

 

The Planning Officer reported that the application site consists of a detached dwelling on the west side of an unmade road leading to Fairview Farm, on the north side of Stepshort. The south-western boundary of the site adjoins the rear gardens of dwellings fronting Stepshort, whilst a woodland copse lies directly to the north and north-east. Rose Farm Touring Park lies on the east side of the road.



The Planning Officer reported that the application relates to a proposed caravan shelter to be sited to the north of the dwelling, which would be accessed via the existing access drive into the dwelling. A large garden extends around the existing copse to the north and north-east of the dwelling. A number of trees are within the site, including 29 Oak trees which are protected by a group TPO. The adjacent woodland to the north-east is also protected by a TPO.

 

The Planning Officer reported that the application proposes a detached caravan shelter within the garden area, sited approximately 17.4m from the main dwelling, along the north-east boundary. The shelter would be accessible from the existing driveway of the site. The shelter would be approximately 3.72m in overall height, with a pitched roof and partially open sides. The shelter would measure 10m by 3.6m, and would consist of vertical metal cladding of a colour and type to be agreed.

 

The Planning Officer reported that although NCC Ecology had originally requested a bat roost survey due to the removal of a tree, now that the trees on site are proposed to be retained, the potential habitat will remain on site and no further surveys are required. Provision of new biodiversity enhancements is not considered necessary or reasons due to the modest scale of the proposal and its lack of impact. As the trees are appropriately retained and protected, the proposal is considered to comply with policies CS11 and E4.

 

The Planning Officer reported that having considered the details provided, when subject to the conditions recommended, the application is considered to comply with policies CS09 and CS11 of the Core Strategy, H9, A1 and E4 of the Local Plan Part 2, and draft Policies 5 and 6 of the emerging Belton with Browston, Burgh Castle and Fritton with St Olaves Neighbourhood Plan.

 

The Planning Officer reported that there have been no material considerations raised to suggest that the application should not be determined in accordance with the adopted development plan. It is therefore recommended that the application should be approved subject to the conditions proposed.

 

The Planning Officer reported that it is recommended that application 06/24/0713/HH be approved and planning permission should be granted subject to the proposed conditions listed in the agenda report.

 

The Planning Officer reported that the applicant has since confirmed that the colour of the shelter will be green, however given the level of variation this could involve, Officers recommend that the precise shade or RAL is confirmed prior to construction of the caravan shelter. As such, Condition 4 remains as a recommended condition as presented in the published agenda report.

The Planning Officer reported that this application was reported to the Monitoring Officer as an application submitted by the Borough Council, as applicant, for determination by the Borough Council as Local Planning Authority. 

 

The Planning Officer reported that the application is for the installation of external signage on the front and side elevations and front fascia: 1no. internally illuminated halo logo and name fascia sign to front elevation; 2no. non-illuminated raised-letter fascia signs to front elevation; 4no. non-illuminated high-level projecting dibond flag signs to front elevation; 1 no. internally illuminated halo logo and name sign to side gable. Window and door decals to front, side and rear elevations.

 

The Planning Officer reported that the type of advertisement proposed and means of illumination is such that public safety on roads will not be affected and it is noted that the Highway Authority has raised no objections. Therefore, the proposals are acceptable in terms of public amenity, having regard to the Advert Regulations and Core Strategy Policies CS9(f) and CS16(c). For these reasons, it is concluded that the proposed advertisements would not cause harm to the character and appearance of the area and are acceptable in terms of the amenity and public safety of the area. There have been no material considerations raised to suggest that the application should not be determined in accordance with the adopted development plan. It is therefore recommended that the application should be approved subject to the conditions proposed.

 

The Planning Officer reported the following updates:-

 

(i) Paragraph 6.1 – The application was also advertised by Press Notice with a consultation expiry date of 21 February 2025; and

(ii) Officers received further proposals for the artwork of ‘The Place’ dibond rigid flags outside the building (received 21 February 2025). These new designs replace those originally submitted and described in the published report; these are minor variations which will be demonstrated in the Committee Meeting.

 

The Planning Officer reported that it is recommended that application 06/24/0988/A  be approved as per the published agenda report with updates to:-


(i) Condition 2 – The 4th bullet point - drawings showing dibond signs - is deleted and replaced with:-


“Dibond signs - Revised Artwork for ‘The Place’ dibond rigid flags, received 21 February 2025.”

(ii) Condition 3 – The published recommended condition is deleted and replaced with:-


For the avoidance of doubt, the halo illumination of the ‘P’ bookmark logo and ‘The Place’ main name sign to the left-hand side of the east elevation fascia (front façade) shall not be illuminated above the maximum colour temperature rating of 3500K (Kelvins) at any time, in accordance with the specification provided on approved plan: Proposed External Signage Elevations (Amended), received 12 February 2025.

The Planning Officer reported that This application was reported to the Monitoring Officer as an application submitted by the Borough Council, as applicant, for determination by the Borough Council as Local Planning Authority.

 

The Planning Officer reported the following update:-

Paragraph 6.1 – The application was also advertised by Press Notice with a consultation expiry date of 21 February 2025.

 

The Planning Officer reported that the application is for works to engrave an additional name to the Second World War Memorial. The proposed engraving is to take place on the east-facing wall (the inner face of the horseshoe) of the WWII memorial, within the Auxiliary Territorial Service (ATS) nominations. A sizeable amount of names featuring on the memorial were from the ATS (Auxiliary territorial service). One ATS member who lost her life in the attack was Lilian Grimmer. Ms Grimmer was born in Cobholm, Great Yarmouth, and served as a Private in the ATS (Auxiliary Territorial Service). On the morning of 11th May 1943, 26 women of the ATS were killed when enemy Focke-Wulf fighter planes bombed their quarters in Great. At present, Lilian Grimmer's name does not appear on the WWII Memorial in St George's Park.

 

The Planning Officer reported that the proposal upholds the historical and commemorative integrity of the memorial by ensuring all local wartime sacrifices are properly recognised, in line with Policy CS10, which requires heritage assets to be conserved and enhanced, and Policy E5, which ensures that changes respect the historic setting. By matching the existing engraving style, the proposal maintains the architectural and visual consistency of the memorial, as confirmed by the Conservation Officer.



The Planning Officer reported that since the site is located in the No.15 St. George’s Conservation Area, both Policy CS10 and Policy E5 require that the development preserves or enhances the area’s historic character. Adding a single engraved name to the memorial involves minimal physical alteration that retains the memorial’s existing style and form. As such, it constitutes very little if any harm to the asset’s significance, and any harm would be considered very low on the scale of ‘less than substantial harm’. Any negligible impact is outweighed by the clear public benefit of ensuring the historical record is complete, aligning with the NPPF principle of making sure that any harm is only accepted if justified against the wider public interest.



The Planning Officer reported that it is recommended that application 06/25/0010/LB should be approved and listed building consent should be granted subject to the proposed conditions listed in the agenda report.

 

The Chair reported that the inscription would be the same font and size.

 

Councillor Newcombe welcomed the addition and fully supported the application as it was important that the work of the ATS woman was honoured in this way.

The Planning Officer reported that this is an application for the installation of artwork sculpture, a bronze statue of Ernie Childs and herring barrel, with 3no. oak benches, on a steel sub-frame. This application proposes to install a bronze statue of Ernie Childs, a local fisherman, leaning on a herring barrel, positioned in front of 3no. oak benches. The statue is life-sized and mounted on the floor, with the subframe used as a foundation below ground. The benches are rectangular, arranged in a crescent shape set 1.8m from the statue. The applicant proposes this to be interactive with opportunities to ‘yarn with Ernie’ and take photos with the backdrop of the Market Place behind.

 

The Planning Officer reported that the proposed sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the historic character of the area. The proposal would have a neutral impact on the Conservation Area and setting of nearby Listed Buildings and would be ancillary to the function of the open space. The proposal is considered to comply with Core Strategy Policies CS1, CS8, CS9, CS10 and CS16 and Local Plan Part 2 policies GSP1, GY1, A1, E3 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

 

The Planning Officer requested an amendment to the published recommendation, to allow delegated authority to determine the application once the consultation period has completed.

(i) A response has been received from Historic England stating that they are supportive of the scheme and its aim of encouraging exploration of the historic town through public art; and

The Planning Officer reported that the application site is located within Anchor Gardens, adjacent to the walkway along the sea front, on an area of grassed land. Anchor Gardens is a area of formal garden situated between the bus Marine Parade and its various tourist attractions and offers, and the open expanse of beach to the east.

 

 

The Planning Officer reported that as part of a programme of town centre investment and regeneration, the applicant has commissioned a public art trail; a circular route of 12 pieces of public artworks intended to guide participants around Great Yarmouth from the seafront to the historic town centre. The artworks are intended to celebrate the heritage and culture of Great Yarmouth, from its role as circus capital, its maritime and medieval history, and its embracing of clean energy and transport links.

 

The Planning Officer reported that of the 12 artwork pieces, two are proposed as permitted development and do not require referral to the Committee. This is one of the ten applications referred to Committee as Connected Applications.

 

The Planning Officer reported that this application seeks planning permission for a sculpture of two joined seahorses, constructed in bronze cast, on a 0.6m x 0.6m x 0.8m plinth. The height of the artwork would be 1.6m on top of the plinth, with a width of 0.8m.

 

The Planning Officer reported that the proposed sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the historic character of the area. The proposal would have a neutral impact on the Conservation Area and setting of nearby Listed water trough and would be ancillary to the function of the open space. The proposal is considered to comply with Core Strategy Policies CS1, CS8, CS9 and CS10 and Local Plan Part 2 policies GSP1, GY6, A1, E3 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

The Planning Officer reported that this application proposes to install a sculpture of a Juggler. The sculpture would be sited upon a concrete pad and would be approximately 3m in overall height.

 

The Planning Officer reported that the proposed juggler sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the character of the area. The proposal would have a neutral impact on the Conservation Area and setting of the nearby Listed Building, and would be ancillary to the open space and would not harm the nearby trees subject to being undertaken in accordance with the mitigation measures of the facilitating tree works proposed in the submitted arboricultural report, which can be secured by planning conditions. When subject to the recommended conditions, the proposal is considered to comply with Core Strategy Policies CS1, CS8, CS9, CS10 and CS11 and Local Plan Part 2 policies GSP1, GY6, A1, E3, E4 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

The Planning Officer reported that the application site sits at the eastern end of Regent Road with the junction of Marine Parade. This area forms somewhat of a plaza to the northern end of the Golden Mile and has some of the most concentrated levels of tourist activity in the borough, and is framed by tall terraced buildings containing shops, kiosks, bars on the west and hotel and attractions south and east.

 

The Planning Officer reported that the proposal is to install a heart sculpture, with an overall height of 5m, a width of 1m, and length of 2.5m, within the public realm at the eastern end of Regent Road. The artwork consists of a heart made of recycled coloured perspex on a steel post and would require a concrete foundation set below ground. The works involved will require some of the paving to be lifted and a concrete foundation cast into the location of the installation, foundation measurements of: length 1.2m, width 1m and depth 60cm. The sculpture will be installed onto a prefabricated base plate with bolt fixings.

 

The Planning Officer reported that the proposed heart sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the colourful character of the area. The proposal would have a neutral impact on the Conservation Area and would not generate any adverse impacts on highway safety.

The Planning Officer reported that the application site is the plaza immediately south of the St Georges Theatre and café.

 

The Planning Officer reported that the published agenda report has listed the wrong date for the end of the public consultation period. The consultation period expiry date as advertised in the Press Advert is 28 February 2025. The consultation period must conclude before the final planning decision can be issued, so a formal decision cannot be issued before 03 March 2025. Officers consider it is unlikely that any further public comments will be received, as the consultation period began on 31st January and no adverse comments have been received to date.

 

The Planning Officer reported that a response has been received from Historic England stating that they are supportive of the scheme and its aim of encouraging exploration of the historic town through public art.

 

The Planning Officer reported that the proposed sculpture is a pair of large, oversized clown shoes, cast in bronze and set on the paving along the trail. The shoes are orientated to be south-east facing and painted in red, blue and yellow colour, positioned directly in front of the café’s south-facing entrance. The shoes are constructed on a steel frame which is set below the ground, so the shoes are positioned directly onto the hard-landscaped /paved theatre courtyard surface. The shoes are 35-40cm tall and 110cm long. The Applicant has chosen the sculpture to be positioned outside the theatre to provide a fun piece of visual interest, but also invite the viewer to interact with the piece, for example to compare their own shoes or take photos that look like they are wearing the sculpted shoes.

 

The Planning Officer reported that the proposed sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the colourful character of the area. The proposal would have a neutral impact on the Conservation Area and setting of listed buildings. The application has positive aspects associated with celebrating the theatre and circus culture of Great Yarmouth and in that respect may also attract a low level of antisocial behaviour from gatherings and creation of noise and disturbance for example, but this is not considered to be of such a level that it would generate an unacceptable degree of adverse impacts on either residential of commercial amenity.

The Planning Officer reported that this proposed sculpture is an abstract spiral symbolising renewable energy, constructed from 10mm thick Corten steel and mounted on a concrete plinth. The sculpture stands at 2.68m high, 2.025m wide, and 0.93m deep, with the plinth measuring 0.6m in height, 1.5m in length, and 1.05m in width. The artwork is designed to be visually striking, reflecting themes of nature, sustainability, and Great Yarmouth’s coastal identity. The sculpture will be positioned securely on the plinth without requiring any paving alterations, ensuring it integrates seamlessly into the public realm. The structure will be affixed using stainless steel bolts, maintaining durability and stability in an outdoor setting.

 

The Planning Officer reported that the proposed sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the colourful character of the area. The proposal would have a neutral impact on the Conservation Area and would not generate any adverse impacts on highway safety. Although there is a small possibility of leading to antisocial behaviour the level of disturbance is not expected to become unacceptable, and would be outweighed by longer term benefits associated with the cultural recognition and enhanced and tourism attraction.

The Planning Officer reported that this sculpture consists of a life-size horse sculpture made from strengthened/reinforced fibreglass which would be mounted and bolted to a concrete plinth. The overall height would be just over 2m in height, 2.3m in length and 0.7m in width. The horse has been painted black and includes images of the late author and the surrounding context. The horse statue is made of fibreglass: strengthened/reinforced to help avoid the threat of vandalism (especially from people sitting on the back of the horse), including varnish which is guaranteed to be suitable for use outdoors for 20+ years and also resists graffiti.

 

The Planning Officer reported that the proposed Black Beauty sculpture is considered acceptable in principle and would contribute to the public realm and be in keeping with the historic character of the area. The proposal would have a neutral impact on the Conservation Area and setting of nearby Listed Buildings and would be ancillary to the function of the open space and would not have an adverse impact on amenity or trees if subject to appropriate planning conditions. The proposal is considered to comply with Core Strategy Policies CS1, CS8, CS9, and CS10 Local Plan Part 2 policies GSP1, GY1, A1, E3, E4 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

Councillor Murray-Smith asked how graffiti-proof paint worked, and if it was effective, why did the Council not use it in all public areas. The Development Manager reported that he would contact the applicant for an explanation and report back to the Committee. However, the use of this paint was not a planning issue.

 

Councillor Bird asked how high the statue of the horse would be. The Chair reported that the height would be just over 2m.

 

Councillor Pilkington asked if signage would be place at the statue asking the public to refrain from climbing. The Development Manager reported that it would be sited in an open area where there was housing and that this would hopefully deter anti-social behaviour.

The Planning Officer reported that the application seeks to install two life-size figures, collectively titled “The Silent Dance,” at the junction of Regent Road and South Market Road, adjacent to 32a Regent Road. Each figure is cast in silicon bronze and includes a stainless steel framework with a 2.0m x 1.7m x 0.75m depth foundation frame below ground, for stability.  The sculptures will stand on street level, with the male figure having a height of 1.8m and the female figure 1.65m, of 0.65m width and 0.45m in depth. To secure the artwork, sections of existing paving will be lifted and a concrete foundation cast in place, into which stainless steel rods will be anchored.

 

 

The Planning Officer reported that the proposed “Silent Dance” sculpture is considered acceptable in principle, enhancing the public realm and fitting in with the vibrant character of the area. It has a neutral impact on the Conservation Area and avoids a detrimental impact on the setting of the nearly listed building, and poses no significant highway safety concerns or likely detrimental impact to amenity. The proposal complies with Core Strategy Policies CS1, CS8, CS9, CS10, and CS16, as well as Local Plan Part 2 Policies GSP1, GY5, A1 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

Councillor Robinson-Payne reported that each statue would have a QR code for explanation and narrative.

 

Councillor Newcombe reported that art was subjective and in the eye of the beholder. The sculpture trail would enhance our culture and heritage offer and she congratulated all those concerned in producing it.

The sculpture would have a total height of 7.5 metres and the ‘tightrope’ the walker is balancing on would be 3.8 metres wide spanning the single lattice framework tower. The vertical position of the "Tightrope Walker" figure will be maintained by a pendulum counterweight, which also serves as a "sail" propelling the figure into motion with the wind

 

The Planning Officer reported that the proposed tightrope walker sculpture is considered acceptable in principle and would contribute to the public realm and its think profiles and see-through form ensures it appears light and unobtrusive despite the height proposed, and as such is considered to be in keeping with the open character of the area park space and framing created by the taller terraced properties either side. The proposal would have a neutral impact on the Conservation Area and would be ancillary to the function of the open space. The proposal is considered to comply with Core Strategy Policies CS1, CS8, CS9, CS10 and CS16 and Local Plan Part 2 policies GSP1, GY6, A1, E3 and E5, and it is not considered that there are any material considerations which would suggest the application should not be determined in accordance with the adopted local development plan.

Councillor Boyd asked if the trapeze was fixed. The Development Manager reported that it was fixed laterally but could move with the wind. The Chair reported that the trapeze element was enclosed and would act as a sail and move backwards and forwards.

 

Councillor Galer wondered whether the local bird population would roost on the sculpture. The Development Manager suggested that they might perch.

 

Councillor Robinson-Payne asked whether the sculpture was open and could be seen through as local residents had complained in regard to 2 or 3 trees which had been planted in the centre of the green and had been moved to the side of the green so as to not disturb their view. She also voiced concerns in regard to ASB & H & S concerns in regard to this application.

 

The Development Manager reported that H & S concerns in regard to the sculpture being used as a climbing frame had been muted and the applicant would need to take this into account and manage it accordingly. The applicant has been asked to supply H & S information and Public Liability insurance. Permitted development could allow the sculpture to be enclosed by fencing up to 2m high which would close it off to the highway.
