TPO (No.1 of 1965) has the public amenity value that warrant their protection. However, as these trees were listed under a previous area-wide order, there is some uncertainty under the existing TPO as to which trees the order applies too. By varying the existing TPO (No.1 of 1965) to remove their A2 designation, and creation of new TPO (No.11 of 2024) which specifies the individual trees, would reduce The individual specification of those trees covered by the existing however by specifying those trees within a new TPO (No.11 of 2024) would reduce uncertainty regarding which trees benefit from protection under Section 198 of the Town and Country Planning Act 1990. 

 

Through assessment, the alternative option not to vary the existing TPO (No.1 of 1965) and creation of new TPO (No.11 of 2024) has been discounted due to the future uncertainty that may arise regarding which trees benefit from protection.
